Terms

Contract: -

When you submit a booking via our online reservation system or via a third-party booking agent you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your deposit payment has cleared, and your booking is subsequently confirmed in writing by post or email. Provisional bookings will be held for a maximum of seven days and will only be confirmed on receipt of the booking form and deposit or full payment if your arrival day is within 30 days of booking. The Contract shall be deemed to have been made at our office WCC Ltd, Pitstruan and be subject to Scottish Law and the exclusive jurisdiction of the Scottish Courts. These conditions of hire form the basis of our contract with you. If you make a booking by phone we will confirm by email or by post and a contract will exist on receipt of your confirmation in acceptance with the terms and conditions.

The total number in your party shall not exceed the capacity of the accommodation as advertised. All male/female and non-family groups are accepted and must be over the age of 18 to make the booking who agrees on behalf of all named person to abide by the contract. A security deposit of £250 applies to all bookings for the cottages and apartments, £300 for Feochan Bheag, Tigh Na Sith, Blackmount and Achalic Farmhouse. This will be preauthorised against a credit card to which you booked with on the day of your arrival. Should you arrive at any property with a group which does not meet these criteria we reserve the right to refuse the use of the accommodation. Please note due to Covid 19 there are legal restrictions on the number of households that can book accommodation together. Please check your booking meets these criteria as you may be refused use of the accommodation if you cannot satisfy us that you meet the regulations.

We also reserve the right to refuse to hand over accommodation to any person(s) who, in our opinion, is not suitable to take charge of it. In such cases, all hire charges paid will be refunded in full and the Contract shall be cancelled. If, in our opinion, any person(s) is not suitable to continue the holiday because of unreasonable behaviour, damage to property, the Contract may be terminated, and you will be asked to leave the premises. In this event the hirer shall remain liable to pay the hired price and no refund will be due. The hirer is liable for any damage caused to the holiday home. We have the right to enter any accommodation (without prior notice if this is not practicable or possible) if special circumstances or emergencies arise.

 

Payments: -

  1. Deposit

A non-refundable 25% deposit of the holiday cost is payable at the time of booking. Bookings made less than four weeks before your arrival date must be paid in full, plus the refundable damage deposit. 
Bookings made online are provisional until confirmed by West Coast Cottages Ltd, we highly advise you to seek appropriate holiday insurance for your booking that will cover in the event of cancellation and will be required to continue to accepted our terms and conditions regarding cancellation.  

  1. Balance

The balance is due 28 days prior to your holiday arrival date if you have paid online through our booking system, your balance can be automatically processed against the same card, please note if your booking is made within the 14 days of your arrival date full balance will be taken at time of booking. 
Upon receipt of full balance, we will send you specific directions to your chosen property with a security code for the lockbox, in which the front door key will be enclosed.

Provisional Bookings:-
Telephone requests shall be held for 48 hours whilst we await your booking details and deposit payment.
In the case that the booking is made within 28 days of arrival full payment is due immediately.

Security Deposit:-
48 hours before arrival, a security deposit of £250 per property, £300 for Feochan Bheag, Blackmount, Achalic Farmhouse & Tigh Na Sith is pre-authorised on the card that was used to make the booking.
This is held securely and released within 48 hours of departure assuming there are no damages or excess cleaning charges applicable.
This is confirmed in your initial booking form.

Deposit and Cancellation Insurance:-
In the event of cancellation, please send us email confirmation to notify us immediately of cancellation to the Mossman’s at info@west-coast-cottages.co.uk

Please note when making the booking we highly advised you to take out appropriate holiday insurance to cover you thus your own responsibility if not taken out. 

If you cancel your holiday more than 6 weeks before it is due to start and insurance is not taken out your deposit will be forfeit. If you cancel less than 6 weeks before the holiday, and we do not manage to re sell the property then the full balance remains due and is not refundable. As this is a legal contract, all of your liabilities as stated above may be covered if you have Cancellation Insurance and we strongly recommend all our guests to ensure that you have appropriate cover in place. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation. (where there is lockdowns we will refund you but only for lockdowns) In all instances the booking/administration fees are non-refundable. 

 

Force Majeure: -
We regret we cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to force majeure. Circumstances amounting to force majeure include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your holiday home (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic, pandemic and all similar situations beyond our control. In such an event we will endeavour to offer you alternative holiday accommodation or an alternative date if available. If we cannot do so or if you do not wish to accept the alternative we offer, we will issue a credit note for all monies you have paid – only redeemable at the original property booked.

Where any cancellation or change results from force majeure, our liabilities are limited to offering you an alternative holiday home (where available) or full refund by way of a credit voucher as set out above. We regret we cannot pay any compensation or meet any expenses or costs you may incur as a result of any such cancellation or change. If you have accepted a credit in lieu of a refund our standard cancellation terms and conditions are applicable when you rebook. Likewise, if your original booking is moved/altered due to force majeure then our original terms and conditions are applied. Please note, bookings made subsequent to March 23rd, 2020 are made in the full knowledge of the potential travel disruption that may continue to result from Coronavirus. 

Alteration of a Booking: -
When the Agent has accepted a booking, the cottage booked can only be changed for another holiday date 6 weeks plus in advance providing the same cottage is available for the new dates and the Owners are agreeable to the change. In either case a re-booking fee of £75 is payable plus any difference there may be in price for the alternative week. If you wish to change to a completely different cottage this can only be changed by treating the original booking as a cancellation (see cancellation terms). A cancellation charge will be applied if the change is 14 days prior to arrival date.

Please note dog fees can not be refunded after the balance has been taken.  

Accommodation Damage & Misuse:-
We ask that the property is left in a clean and tidy condition and that should any items be accidentally broken or damaged that you undertake to inform us at the time & as required replace or repay.
We would expect the property you hire to be left in a clean & tidy manner "as you found it".
Should this not be the case or the property is damaged in any way by negligence and we have not been informed & agreed on a settlement, then the cost of replacement or repair will be withheld from refundable security deposit taken at the time of booking.

Complaints: - 

All complaints must first be referred to West Coast Cottages (Agent) or the Owners during their stay to allow for immediate remedial action to be taken to ensure you have the best stay. In no circumstances can compensation be made for complaints raised only after the stay has ended when the guest has denied the Owners or Agent the opportunity of investigating the complaint and endeavouring to put matters right during their stay.

Please note we often have departures and arrivals taking place on the same day; in order to avoid anything less than a wonderful arrival experience for subsequent guests, we ask that any damage be reported to us immediately to allow us time to orchestrate repairs or replacements.

Electricity:-
Price of electric has significantly increased and are set to go up again. The prices shown includes the provision of fuel including oil and electricity based on a ‘fair usage’ policy. We will now be monitoring electricity usage and urge all guests to be mindful of consumption please. We reserve the right to charge for excessive use of electricity. 

We will cover 15 kWh per day, excess use from this will be chargeable at cost used from your security deposit which we will contact you about before charge.

Please note - anyone with Electric cars we ask that you kindly charge them at the car charging points provided in town (Tesco) and not at the house you are renting, if found to do so reserve the right to charge for this on excess use. 

Cottage Fuels:-
Properties with open fire/stove will be laid ready to use on arrival this is included in the price, additional supplies of coal, logs, firelighters, and bioethanol are charged as used recorded on payment sheet in individual property, others we ask you to source from your local shop/garage.

Card Payment Detail:-
We are fully PCI compliant and we hold no card or personal details.

Smoking:-

SMOKING is strictly prohibited in all properties and shared amenity areas. Removal of smoke odours in buildings is extremely difficult and we reserve the right to evict anyone who we suspect is smoking or drug taking in any of our properties. Charges will be made to the guest to cover the costs of any cleaning, deodorising and any loss of future rental revenue which may occur as a result of smoking within a property.

Discounts:-
Senior Citizens, those of UK State Pension age, can claim a special discount of 5% on any one week.
All guests must be Senior Citizens and the discount is not available during peak periods.
A special discount of 5% is given on the second or subsequent weeks booked.
A 5% repeat client discount voucher is only available on any one week of holiday and not available during peak periods.
No discounts are available on short break prices.

All discounts must be agreed at the time of booking and not retrospectively.
NB only one discount offer can be taken at any one time, unless with prior agreement.

Pets:-
Pets are welcome in specific properties at a charge of £5 per night per pet, with a max of two dogs per property & only one dog in Tigh Grianach and an cala.
Dogs must be kept under strict control at all times and must not be left unattended in the property.
No pets allowed at Tigh Beg, Grannda Mhor, Argyll Mansions, Imperial Apartment, Burnbank and Tweedale.
Please bring your own pet bedding and under no circumstances allow pets on furniture or access to bedrooms.
Dog mess must be cleared from outside areas immediately.
An excess cleaning charge may be applied if there is evidence of dogs.

Please note dog fees can not be refunded after the balance has been taken.

Availability:-
Availability changes rapidly so to avoid disappointment please telephone or email to secure your preferred date & property.
The booking is made in good faith in the belief that the Property will be placed at your disposal for the dates stated.
If for any reason this is not possible through circumstances not under the control of the Proprietor (e.g. fire, theft or damage) we cannot guarantee to provide an alternative.
In such an event the deposit will be refunded in full and as such you will have no claim against the Proprietor or Agent.
The Proprietors reserve the right to alter or amend the facilities or amenities available without prior notice.

Price Change: -
West Coast Cottages reserves the right to amend prices quoted on the Web site due to errors or omissions but such changes shall be notified to the Guest as soon as possible and the Guest shall be able to cancel the booking if the amended price is significantly higher than the original price quoted

Access: -
The Hirer shall allow the Lender entry to the properties for all reasonable purposes.
In order to maintain the high standard of our properties, our gardeners/maintenance staff may visit the property- they will never ask for access unless agreed and they will respect your privacy at all times.
Four weeks prior to arrival, upon receipt of the full balance payment, we will send you specific instructions to your chosen property along with a security code for the lockbox containing the front door key
During multi-week stays, our housekeepers will change your towels and bed linen halfway through your stay.
Unless you advise us otherwise they will attend the property on the usual changeover day for that particular property.

Minors:-
Bookings for those 16 years and under who are not accompanied by adults cannot be accepted.

Fires:-
No fires are to be lit on any part of the grounds or surrounding land.

Caravans:-
No caravans may be parked on the grounds.

Occupancy:-
The number of people occupying the hired cottage must not exceed the numbers stated on the booking form without prior agreement.

Use of Accommodation: -

The property let is to be used for the purposes of a holiday let to which paragraph 6 of Schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016 applies. The booking agreement confers a right to occupy the accommodation for the agreed period only.      

The hired property shall be used solely for holiday purposes and the Hirer shall not sub-let the properties or any equipment hired to the Hirer.

Hirer's Property:-
No liability is accepted by the proprietor or agent of the cottage for loss or damage to hired or passenger property, baggage, motor car, etc. however caused nor for any accident or mishap to persons whilst on the premises.
The owner reserves the right to refuse admission of persons or pets, who in the opinion of the owner is not suitable to take charge or may cause a disturbance or nuisance which may upset the peace and tranquillity of other holidaymakers.
In the event of termination of a let for these reasons, a refund of any unexpired portion of the rent will be made.
